The Moon Calendar

This privacy policy (the “Policy”) governs how we, The Moon Calendar (Laura Haworth) and its affiliates (“”The Moon Calendar”, “we”, “our” or “us”) use, collect, store and disclose information pertaining to you (your personal data) (“the User”, “you”), when you use our Service(s)/App(s)/Website (used interchangeably) and the choices you have associated with that data, in the following, including but not limited to, cases:

  1. When you browse or visit our App/Services/Website;
  2. When you make use of, or interact with, our App/ Website, and the services provided thereunder (collectively referred to as the “Services”)when you contact us (eg. Customer support, help, submit a request);
  3. when we use personal data from of our service providers; and
  4. when we use the personal data of our customers.

The Moon Calendar mobile application and Website shall be known as the “Service” or the “App” interchangeably or together.

We use your Personal Data (see definition below) to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this Policy. Unless otherwise defined in this Policy, terms used in this Policy have the same meanings as in our Terms and Conditions.

We greatly respect your privacy, which is why we make every effort to provide a platform which lives up to the highest of data protection standards. Please read this Policy carefully, so you can fully understand our practices in relation to Personal Data. 

Personal Data” means any information that can be used, alone or together with other data, to uniquely identify any living human being. Please note, this is a master privacy policy and some of its provisions only apply to individuals in certain jurisdictions.

  1. INFORMATION COLLECTED

We may collect information regarding your geo-location or access your mobile device when you us our Service/App(s).

If you use our Services/App(s), we may also collect the following information:

Geo-Location Information: We may request access or permission to access location-based information from your mobile device, to provide you with location-based services. If you wish to change your access or permissions to your geo-location information, you may do so in your mobile device’s settings.

Mobile Device Access:  We may request access or permission to use certain features of your mobile device, including but not limited to, your mobile device’s Calendar, Contacts, Reminders, camera, pictures/photos and Apple Health, and other features. If you wish to change your access or permissions, you may do so in your device’s settings. 

Google Tasks Access: We request access to your Google Tasks in order to display these in a to-do list section (“Tasks” section). 

  1. HOW WE USE YOUR INFORMATION

We process your information for purposes based on legitimate business interests (“Business Purposes”), the fulfilment of our contract with you, compliance with our legal obligations, and/or your consent.

We use Personal Data collected via our Services/App(s) for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you (“Contractual”), with your consent (“Consent”), and/or for compliance with our legal obligations (“Legal Reasons”). We indicate the specific processing grounds we rely on next to each purpose listed below.

The information we collect or receive is used as described below:

  • your location – is used to select your location on a map.  Geofencing is done from the Reminders app (iOS only). We do not track your location;
  • your camera and heading – is used to calculate the augmented reality compass (iOS only) (these are stored temporarily on your device only, and never sent to our servers);
  • your birth date and birth place – is used to calculate natal transits  (these are stored on your device, and can be deleted by deleting the app);
  • your calendar items – is used to populate your Calendar section (these are stored temporarily on your device only, and never sent to our servers);
  • your reminders – is used to populate your Reminders section (iOS only)  (these are stored temporarily on your device only, and never sent to our servers);
  • your Google Tasks – is used to populate your Tasks section (Android only) (these are stored temporarily on your device only, and never sent to our servers)
  • your Photos – allows you to select and export a photo from your photo gallery on your mobile device and [upload or set it for] your Intentions, Journal and Self-care/Rituals sections; (these are backed up on iCloud or Google CloudStore)
  • your Contacts – allows you to search addresses when adding a location to your calendar events (iOS only);
  • your Apple Health Data – is used to display your menstrual cycle data in the calendar and journal sections of our app (iOS only); (Only you will be able to see this information); (these are stored temporarily on your device only, and never sent to our servers)

The Service/App(s) use third-party services which may collect information that is used to identify you. These third-party services are listed below:

The Moon Calendar on iOS:

The App/Services(s) use Apple CloudKit to backup and sync data between all your Apple devices. Your Journal, Intention and Recipe/Ritual Text Data is stored in a private database, which is encrypted with an account-based key. We do not have access to any data stored in your iCloud account. We also do not have access to your Apple ID – we only have access to a unique identifier that is scoped to our app only. It is not possible to track your identity between apps with this identifier.

Your Recipe images are stored on a database which is accessible to us only. 

You can revoke our access to your iCloud and in doing so delete all your private data by going to your iOS Settings on your iOS mobile device.

The Moon Calendar on Android:

The App uses Firebase Cloud Firestore and Firebase Cloud storage to backup and sync your data between Android devices. Your Journal, Intention, Menstrual cycle days and Recipe/Ritual Data is stored using Firebase which uses secure protocols to exchange the data, and user data is separated and restricted using security rules. You email address and password will not be used for anything except authentication. To delete your data press “delete all data” in the app’s “Help & Settings” section.   1. LOG DATA

Whenever you use our App/Service, we collect data and information (through third-party services) on your mobile device called Log Data. This Log Data may include information such as your: device Internet Protocol (“IP”) address, device’s name and operating system version.  It may also collect information such as: the configuration of the App when utilising it, the time and date of your use of the App, referring/exit pages, clicked pages and other statistics or information your mobile device or browser may send to us. We may use this information to analyse trends, administer the Website or App, track users’ movements around the Website or App, and gather demographic information.

  1. COOKIES

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites or apps that you visit and are stored on your device’s internal memory. They can be used, for example, to collect information about activity on the website or app. Certain cookies and other technologies may serve to recall Personal Information, such as an IP address, previously indicated by a user.

This App/Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

  1. THIRD PARTY SERVICE PROVIDERS

I may use/employ third-party services (from third party companies and individuals) for any of the following reasons:

  • to facilitate our Service;
  • to provide the Service on our behalf;
  • to perform Service related services; or
  • to assist us in analysing how our Service is used.

The third-party service providers shall obtain access to your Personal Information. They have access to this information, so that they can undertake the tasks assigned to them on our behalf. However, they are strictly obligated not to disclose or use the information for any other purpose than the one assigned to them.

  1. HOW LONG DO WE KEEP YOUR INFORMATION?

Your information (location, birth-date and birth-place) will only be stored on your device and can be deleted by deleting our App. Your journal entries, intentions and private recipes are stored on iCloud/Firebase until you delete them.

For iOS users, you can revoke our access to your iCloud and in doing so delete all your private data [stored on our App] in the iOS Settings app on your iOS device. 

For Android users you can delete all your data stored on Firebase by tapping “Delete all data” in the App’s “Help & Settings” section, and log out of the app.

  1. HOW DO WE KEEP YOUR PERSONAL DATA SAFE?

We aim to protect your personal information through a system of organisational and technical security measures. We have implemented appropriate technical and organisational security measures designed to protect the security of any personal information we process.

However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although, we will do our best to protect your personal information, transmission of personal information to and from our App(s) is at your own risk. You should only access the App/service(s) within a secure environment. The security of personal data/information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your IDs and passwords.  Please make sure to take appropriate measures to protect this information.

  1. USE OF ANONYMOUS INFORMATION

We may use Anonymous Information (as defined below) or disclose it to third-party service provider in order to improve our Website and services and enhance your experience with the App/Service(s). We may also disclose Anonymous Information (with or without compensation) to third parties, including advertisers and partners.

Anonymous Information” means information which does not enable identification of an individual user, such as aggregated information about the use of our Website.

  1. MINORS / CHILDREN

We do not offer our products or services for use by children. We do not knowingly collect data/information from or market to children under 18 (eighteen) years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the App(s)/Service, you represent that you are at least 18 years of age or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the App(s)/Service. If we learn that personal information from users less than 18 years of age has been collected (without consent from their guardian), we will deactivate the account and take reasonable measures to promptly delete such data from our records.   1. DELETING YOUR ACCOUNT

Should you ever decide to delete your Account, you may do so by emailing support@themooncalendar.app.

If you terminate your Account, any association between your Account and your personal information stored on our App, will no longer be accessible to you through your Account. However, given the previous nature of sharing on the Service(s)/App(s), any public activity on your Account prior to deletion will remain stored on our Service(s)/App(s) and will remain accessible to the public.

  1. WHAT ARE YOUR PRIVACY RIGHTS?

European Economic Area (GDPR)

If you are living in a region such as the European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. Please see below for a full list and description of these rights. In certain circumstances, you may also have the right to object to the processing of your personal information. The following rights (which may be subject to certain exemptions or derogations), shall apply to certain individuals (some of which only apply to individuals protected by the GDPR in certain circumstances):

  1. You have a right to access information held about you. Your right of access is normally be exercised free of charge, however we reserve the right to charge an appropriate administrative fee where permitted by applicable law;
  1. You have the right to request that we amend any Personal Data we hold that it is inaccurate or misleading;
  1. You have the right to request the erasure of the Personal Data that relates to you. Please note that there may be circumstances in which we are required to retain your data, for example for the establishment, exercise or defence of legal claims;
  1. The right to object to or to request restriction of the processing. However, there may be circumstances in which we are legally entitled to refuse your request;
  1. The right to data portability. This means that you may have the right to receive your personal data in a structured, commonly used and machine-readable format, and that you have the right to transmit that data to another controller;
  1. You have the right to object to profiling;
  1. You have a right to lodge a complaint with your local data protection supervisory authority (i.e., your place of habitual residence, place or work or place of alleged infringement) at any time. We ask that you please attempt to resolve any issues with us before you contact your local supervisory authority.   1. You have the right to withdraw your consent. Please note that there may be circumstances in which we are entitled to continue processing your data, in particular where the processing is required to meet our legal and regulatory obligations.
  1. You also have a right to request details of the basis on which your personal data is transferred outside the European Economic Area, but you acknowledge that data transfer agreements may need to be partially redacted for reasons of commercial confidentiality.

We will consider and act upon any request in accordance with applicable data protection laws applicable to you.

US Privacy Provisions:

Do California Residents have specific privacy rights?

Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” Law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request by emailing us at:  support@themooncalendar.app. Please note that we are only required to respond to one request per customer each year.

If you are under 18 years of age, reside in California, and have a registered account with the Apps, you have the right to request removal of unwanted data that you publicly post on the Apps. To request removal of such data, please contact us by emailing us at support@themooncalendar.app and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Apps, but please be aware that the data may not be completely or comprehensively removed from our systems.

Our “California do not track” notice. We do not track consumers over time and across third-party websites and therefore do not respond to DO Not Track signals. We do not allow third parties to collect personally identifiable information about individual consumers’ online activities over time and across different websites when a consumer uses the Website.

DO WE MAKE UPDATES TO THIS POLICY?

Yes, we will update the Policy where necessary to stay compliant with relevant data protection laws.

We may update the Policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible to the User. If we make material changes to the Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We do however encourage you to review this privacy policy frequently and check back periodically for the latest version to keep yourself informed of how we protect your information.
